NGO Registration
NGO (Non-Governmental Organization) registration is essential for legally establishing an organization to carry out social, charitable, or developmental activities. An NGO can be registered under three main acts in India: Trust Act, Societies Registration Act, 1860, or Companies Act, 2013 (as a Section 8 Company).
Required Documents:
- Identity proof of all founders (Aadhaar, Passport, etc.).
- Address proof of all founders.
- PAN card of the NGO (post-registration).
- Proof of the registered office address (rental agreement, ownership deed, or utility bill).
- Memorandum of Association (MoA) and Rules & Regulations (for Society registration).
- Trust deed (for Trust registration).
- Articles of Association (AoA) and Memorandum of Association (MoA) (for Section 8 Company).
- Passport-size photographs of all members or trustees.
- NOC from the property owner (if applicable).
Process:
- Decide the Type of NGO:
- Trust: Register under the Indian Trust Act.
- Society: Register under the Societies Registration Act, 1860.
- Section 8 Company: Register under the Companies Act, 2013.
- Draft the Governing Documents: Prepare the Trust Deed, MoA, and AoA, depending on the chosen structure.
- Apply with Registrar/Authority:
- Trust: Submit documents to the Registrar of Trusts.
- Society: Apply to the Registrar of Societies in your state.
- Section 8 Company: Apply online through the MCA portal.
- Verification: The authorities will verify the application and documents.
- Certificate of Registration: Once verified, the organization will receive the registration certificate.
- Post-Registration: Apply for PAN, open a bank account, and optionally apply for tax exemptions (12A/80G).
